(1) At the time of final inspection of a Single Unit or Two Unit Dwelling in a Subdivision, the builder shall submit documentation on a form approved by the City that the homeowner has been notified of the Landscaping requirements of this Title and will comply with said requirements. No Certificate of Occupancy shall be issued until all other requirements are met and this documentation is submitted.

(2) All Front Yard Landscaping required by this Title shall be completed within one year of issuance of a Certificate of Occupancy unless otherwise provided herein.

(3) Any improvements required under this Title shall be satisfactorily installed prior to final inspection approval by the Building Inspection Division or, if no electrical inspection is required, prior to issuance of a Certificate of Occupancy or business license. In lieu of completion of improvements prior to final inspection approval or Certificate of Occupancy, a developer may submit a bond in an amount specified by the City and in a form acceptable to the City Attorney’s Office guaranteeing completion of said improvements within one year. In lieu of the bond requirements of this subsection and at its sole discretion, the City may offer the options set forth in Section 7-2-117.

(4) Upon completion of required improvements, the developer is responsible to request an inspection by the City, which shall be completed within a reasonable time. If the inspection verifies compliance with all City requirements and specifications, the bond shall be released within a reasonable time. If the bond is not released, the refusal to release the bond and the reasons for such refusal shall be given to the developer in writing within a reasonable time. Partial release of a bond may be made based upon the percentage of completion of required improvements.

(5) If the Building Inspection Division determines that issuance of final inspection approval or Certificate of Occupancy prior to completion of required improvements would be harmful to the health, safety, and welfare of the City or its inhabitants, it may refuse to accept a bond in lieu of actual completion.
