(1) Applicants or other individuals performing work in any Right-of-Way or other public property shall:

a. Restore the Right-of-Way to its original condition within 48 hours of demand for such restoration by the Department;

b. Maintain the entire work site appropriately during the period of construction; and

c. After the termination of said work, perform any necessary repairs resulting from settled trenches.

(2) If the applicant or other person performing any work in any Highway or Right-of-Way or other public property fails to perform an act listed in subsection (1) above, the Department is authorized to ensure the restoration of the surface by any means necessary, including but not limited to performing or contracting for the restoration of the surface. The Department shall then send a demand for payment of all expenses incurred in said restoration to the applicant, the property owner, and the surety company, with said payment to be due within 20 days of said notice.

(3) Any applicant who has failed to restore a surface or make payment in accordance with subsections (1) and (2) above shall be ineligible to receive any other excavation permit from the City until said work is performed or said expenses are paid.
