(1) It shall be unlawful for any person to construct any improvement on, install any utility or appurtenance on, bore under, make any excavation in, close any lane or Sidewalk of, or perform any work in any Highway, Sidewalk, Parkstrip, curb, gutter, Right-of-Way, or other public property without complying with the provisions of this Title, the City Engineering Standards, and obtaining a Right-of-Way permit.

(2) Emergency excavations or work may be performed without a prior permit if the excavation or work is necessary to prevent imminent loss of life or property that would occur while waiting to contact the Department. In such situations, the excavating or working parties shall contact the Department immediately and apply for a permit on the first working day following the excavation or work. No requirement or specification is waived for such emergency work.

(3) Any work on private property that is intended to become Right-of-Way must have plans approved by the City, comply with Engineering Standards, apply for and receive a permit, and the work must be inspected and accepted by the City.
