(1) Unless provided otherwise, this Title may be enforced by the Administrative Code Enforcement Hearing Program established in Title 10, or by filing civil or criminal actions as provided by law. The City has sole discretion to decide whether to pursue any or all remedies. The possibility of an administrative enforcement action under Title 10 shall not limit the City’s ability to pursue all civil remedies, criminal actions, or any other remedy available by law.

(2) The City shall have authority to recover for damages to or destruction of any public property caused by, without limitation, negligence, willful action, or violation of applicable statutes, ordinances, or City Engineering Standards. The City may recover by criminal action, civil action, or administrative enforcement action.

(3) The Department shall have authority to enter onto any job site, property, or premises to inspect and determine whether the requirements of applicable laws, ordinances, statutes, regulations, or the City Engineering Standards are being met.

(4) Applicants for any Department permit consent to inspection by the Department to determine whether the terms of the permit are being fulfilled. If any work fails to meet applicable requirements, the Department shall have the authority to order that all work cease until the Department can determine that the work will be in compliance going forward. Any unauthorized work or work which does not meet Engineering Standards shall be removed.

(5) Violations of this Title and failure to comply with any requirement imposed during the permit process or by the City Engineering Standards shall be infractions except for a failure to comply with a stop-work order issued by the Department, which shall be a class B misdemeanor.

(6) Applicants and the person for whom any work is performed are jointly and severally responsible for compliance with this Title, the City Engineering Standards, and any other applicable laws, ordinances, or regulations.
