Whenever any words or phrases used in this Title are not defined herein, but are defined in related sections of the Utah Code or the West Valley City Municipal Code (including but not limited to Title 7), such definitions are incorporated herein and shall apply as though set forth herein in full, unless the context clearly indicates a contrary intention. Words not defined in any Code shall have their ordinarily accepted meanings within the context in which they are used.

Unless a contrary intention clearly appears, words used in the present tense include the future, the singular includes the plural, the term “shall” is always mandatory, and the term “may” is permissive. The following terms as used in this Title shall have the following meanings:

(1) “City” means West Valley City.

(2) “Department” means the West Valley City Public Works Department.

(3) “Highway” is a general term and shall include all roads, streets, alleys, lanes, courts, places, paths, trails, and bridges laid out or erected as such by the public, or dedicated or abandoned to the public, or made such in actions for partition of real property.

(4) “Parkstrip” means that area between the back of curb and the sidewalk.

(5) “Person” includes any individual, firm, company, partnership, corporation, association, or any group or combination thereof.

(6) “Right-of-Way” means the public area between property lines intended for use as a Highway. “Right-of-Way” includes, but is not limited to, the area occupied by Highways, Sidewalks and Parkstrips.

(7) “Sidewalk” means the hard-surfaced area on either side of a Highway, intended for pedestrian use. Sidewalks may be located within the Highway Right-of-Way, or within an easement on the abutting property.
