(1) All long-term post-construction Storm Water management facilities and BMPs shall be subject to an annual inspection by the Division to document maintenance and repair needs and to ensure compliance with the requirements of this Chapter and accomplishment of its purposes.

(2) Any maintenance deficiencies shall be corrected within such time period as is determined to be reasonable by the Division, and the inspection and maintenance requirements may be increased as deemed necessary to ensure proper functioning of the facilities. Additional inspections may be required as determined to be appropriate by the Division.

(3) When any new long-term post-construction Storm Water management facility or BMP is installed on private property, or when any new connection is made between private property and a public Drainage System facility, the property owner shall grant to the City the right to enter the property at reasonable times and in a reasonable manner for the purpose of inspection. This includes the right to enter a property when the City has a reasonable basis to believe that a violation of this Title is occurring or has occurred and to enter when necessary for abatement of a public nuisance or correction of a violation of this Chapter.
