(1) Each Person who alters, improves, constructs upon, or in any other way physically impacts real property by disturbing an area greater than or equal to one acre, including disturbances that are part of a larger common plan of development which collectively disturb land greater than or equal to one acre, shall comply with the requirements of this Title. Prior to taking any action upon property which will affect the retention, drainage, flow, or water quality of Storm Water within the City, each Person shall obtain a Construction Period Storm Water Management Permit, in accordance with the Engineering Division Standards and this Title.

(2) A Long-Term Storm Water Management Permit in accordance with the Engineering Division Standards and this Title is required prior to construction of any development or redevelopment project; provided, however, that Storm Water Management Permits are not required for agricultural activities. As set forth in this Title, the Storm Water Management Permits may, as determined by the Division, require specific actions and consist of one or more components with respect to construction of on-site drainage or Drainage System facilities, connection to existing Drainage System facilities, maintenance of on-site facilities, grading and erosion control, and protection of water quality. Permits may be suspended or revoked by the Division when it is determined to be in the best interest and welfare of the public.
