17-2-200P FIREWORKS
17-2-201. DEFINITIONS – SALE WITHOUT LICENSE PROHIBITED.
(1) For the purposes of this Part, the following definitions apply:
a. “Fireworks” shall be as defined in Title 53 Utah Code Annotated 1953.
b. “Permanent structure” means an immobile building on a permanent foundation that houses a building licensed to sell merchandise in addition to fireworks.
c. “Temporary stand” means a nonpermanent structure used exclusively for the sale of fireworks.
(2) It is a Class “B” misdemeanor to sell, offer for sale, or discharge fireworks except as authorized by this Part.
(3) It is a Class “B” misdemeanor to perform as a flame effects artist without obtaining a license from the state Fire Marshal, a West Valley City business license, and approval of the site and safety measures from the City Fire Marshal prior to any performance.
